THE PROBLEM

What's different in Kenya

01

Mobile money everywhere

The Central Bank of Kenya reports more than 95 million registered mobile money accounts (August 2026). Your customer journeys have to work around payments people make on their phones.

02

Consent is explicit

Kenya's Data Protection Act requires express consent before personal data is used for commercial purposes, and every marketing message must offer a free way to opt out.

03

Registration is often mandatory

Controllers and processors register with the Office of the Data Protection Commissioner. Small businesses can be exempt, but sectors such as financial services, telecoms and direct marketing must register whatever their size.

04

Data leaving Kenya

Transfers abroad need appropriate safeguards or another basis in the Act, and some processing can be required to stay in Kenya.

05

Tools built for other markets

Most platforms are designed and priced with other markets in mind. Getting the setup and the costs right for Kenya takes local thinking.

WORTH KNOWING

Kenya's Data Protection Act, briefly

The Data Protection Act, No. 24 of 2019, is overseen by the Office of the Data Protection Commissioner (odpc.go.ke). This summary explains how we set platforms up. It is not legal advice.

FAQS

The questions people ask us first.

Do you have people in Kenya?

We're based in South Africa, between Johannesburg and Cape Town, and work alongside local partners in Kenya.

Do we need to register with the ODPC?

Probably. Controllers and processors must register unless they fall under the small-business exemption (turnover below KSh 5 million and fewer than 10 employees), and businesses in sectors such as financial services, telecoms and direct marketing must register whatever their size.

Can our customer data be hosted outside Kenya?

Usually, yes, with appropriate safeguards or another basis set out in the Act. Some processing can be required to stay in Kenya, so we check this before choosing platforms.
